Terms of Service
1. Acceptance
By using Polaris — Strategic Marketing OS by Marketising ("Polaris", "the Service") — via the web form at polaris.marketising.ca, the Telegram bot, the MCP server, or any official Claude / Claude Code / Cursor integration that calls our endpoints — you agree to these terms. If you do not agree, do not use the Service. The legal owner is the natural person identified at the bottom of this page; "Marketising" is a product brand under which Polaris is published, not a separate legal entity.
2. What the Service does
Polaris is a bilingual (English + Persian) AI strategic marketing operating system. It takes a brand brief and produces a marketing operating plan composed of up to 8 specialist nodes (Researcher, Strategist, Creative Director, Digital Marketing Manager, CRM, Affiliate & Influencer, Customer Efficiency, Execution Plan). The system auto-tiers across 5 plan modes (Survival, Quick-Start, Lean, Full, Enterprise) based on the brief's budget or revenue. Outputs include bilingual markdown text, Word documents, PowerPoint decks, and HTML reports, with a Source-Citation Appendix in every deliverable.
3. AI-generated content disclaimer

You are responsible for reviewing and validating every recommendation before acting on it. The Service is not a substitute for licensed legal, financial, or marketing professional advice.
Polaris tags every claim it makes with one of four labels —
[VERIFIED · source], [USER-PROVIDED], [AI-INFERRED], [HYPOTHESIS] — and every node ends with a Confidence & Verification Map. Claims tagged AI-INFERRED or HYPOTHESIS (which includes most competitor lists, review sentiment summaries, and trend snapshots unless live retrieval APIs are configured on the server) are analytical drafts, not facts. Treat them as starting points for your own verification before launch or before making spending decisions.

4. Acceptable use
You agree NOT to use the Service to:
- Generate content for businesses you do not own or have authorization to represent
- Create plans for illegal activities, regulated industries you are not licensed in, or content that violates Anthropic's or OpenAI's usage policies
- Submit briefs that contain confidential or sensitive information you do not have rights to share
- Scrape, abuse, or attempt to bypass rate limits
- Resell or rebrand the raw Service output as your own product without substantial value-add

تعهد میدهید که سرویس را برای: تولید محتوای کسبوکارهایی که مالکشان نیستید، فعالیت غیرقانونی، صنایع نظارتی بدون مجوز، اطلاعات محرمانهی بدون اجازه، یا scraping استفاده نکنید.
5. Your content
You retain ownership of the brand briefs you submit and the marketing plans they produce. By using the Service you grant us a non-exclusive, royalty-free license to store, process, and analyze your submissions for the purposes described in the Privacy Policy, subject to the 30-day retention default documented there. If you activate Private Session when submitting a brief (via the form's checkbox or by sending private: true through any API surface), this license is limited to in-memory processing only — nothing is archived, and the license terminates the moment your request completes.
6. Pricing & availability
The Service is currently provided free of charge in beta. We reserve the right to introduce paid tiers, usage limits, or service interruptions at any time with reasonable notice. The Service is provided "as-is" with no uptime guarantee.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost revenue, lost opportunities, or marketing campaigns that underperform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (or $0 if you used the Service for free).
8. Termination
We may suspend or terminate your access at any time for violation of these terms, suspected abuse, or operational reasons. You may stop using the Service at any time.
9. Governing law
These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in the courts of Toronto, Ontario.
10. Changes
We may update these terms; the "Last updated" date at the top will reflect the latest revision. Continued use after changes constitutes acceptance.
